1. Agreement to these terms

These Terms & Conditions ("Terms") govern your use of bpcproc.com and every order you place with BPC — Building Procurement Construction ("BPC", "we", "us", "our"), whether through our website, by phone, or on WhatsApp.

By using our website or placing an order, you agree to these Terms, our Privacy Policy, and our Return & Refund Policy. If you do not agree, please do not use our services.

2. About BPC

BPC is an online marketplace for construction materials in Bangladesh. We supply products such as cement, steel rod, bricks, tiles, cables, sanitary items, and other building materials, sourced from manufacturers and verified suppliers, and arrange delivery to your site.

3. Who can order

You must be at least 18 years old to place an order. You may order as an individual or on behalf of a business or project, provided you have the authority to do so. You agree to give us accurate, complete, and current information when ordering, including your delivery address and contact number.

4. Products, pricing & availability

• All prices are in Bangladeshi Taka (BDT).
• Construction material prices — especially steel rod and cement — move with the market. Prices shown on the website or quoted to you may change without notice until your order is confirmed. Once we confirm your order at an agreed price, that price is fixed for that order.
• Unless we state otherwise, a written quotation is valid for 24 hours from the time it is given.
• Any VAT, taxes, or delivery charges that apply will be stated when you order or in your quotation. VAT invoices are available on request.
• Product images are for illustration; actual packaging and appearance may vary.
• If a product is listed with an obvious pricing or description error, we may correct it. If you have already ordered, we will inform you and you may either accept the corrected price or cancel for a full refund of anything you have paid.
• All products are subject to availability. Listing a product does not guarantee stock until your order is confirmed.

5. Placing an order

You can order through the website, by calling us, or on WhatsApp at +880 1714-736623. Your order becomes binding when we confirm it — by message, phone call, or order confirmation — including the products, quantities, price, and delivery details.

We may decline or cancel an order (before delivery) for reasons such as unavailable stock, a delivery location we cannot serve, failed payment verification, a pricing error, or suspected fraud. If we cancel, we will tell you promptly and refund any amount you have already paid for the cancelled items.

6. Payment

• We accept bKash, Nagad, bank transfer, and cash on delivery (COD) where offered.
• For bulk, high-value, or custom orders, we may require full or partial advance payment before processing.
• Orders paid digitally are processed after we verify the payment. Please send the exact amount and share the transaction ID with your order reference.
• For COD orders, please have the exact amount ready at delivery. Goods remain the property of BPC until paid for in full.

7. Delivery

• We deliver to the address you give us when ordering. Please make sure it is accurate and complete.
• Delivery timelines we give are estimates. Actual timing depends on stock, distance, weather, traffic, and road conditions. We will keep you informed of any significant delay.
• You are responsible for making sure delivery vehicles can legally and safely reach your site, and that you or an authorised person is present to receive the goods.
• Unloading arrangements (who unloads, and any labour charges) are as agreed when you place the order.
• Responsibility ("risk") for the goods passes to you once they are delivered to your address or site.
• If delivery fails because of a wrong address, no site access, or no one available to receive the goods, a redelivery charge may apply.

8. Inspecting your order

Please count and check your materials at the time of delivery, before the vehicle leaves. If you find a shortage, damage, or the wrong item, point it out to the delivery person on the spot and contact us right away. Full details, including reporting time limits, are in our Return & Refund Policy.

9. Cancelling an order

• Before dispatch: you can cancel free of charge, and any advance payment will be refunded in full.
• After dispatch: if the vehicle is already on the way, transport costs already incurred may be deducted from your refund.
• Custom orders: custom-cut steel, made-to-order, or specially procured items cannot be cancelled once processing has started.

10. Returns & refunds

Returns, replacements, and refunds are handled under our Return & Refund Policy, which forms part of these Terms. Because construction materials are sensitive to weather, handling, and storage, some items have limited return windows or cannot be returned once used, opened, or unloaded — please read that policy before ordering.

11. Product quality & warranties

We supply genuine products sourced from manufacturers and authorised suppliers. Where a manufacturer provides a warranty or quality guarantee, that warranty passes to you and claims are handled under the manufacturer's terms — we will help you make the claim.

Natural materials such as bricks, sand, and stone chips naturally vary in colour, texture, and size within industry norms. Such normal variation is not a defect.

12. Your responsibilities

• Provide accurate order, contact, and site information.
• Use the materials lawfully and follow applicable building and safety rules.
• Store and handle materials correctly after delivery — for example, keep cement dry and off the ground. We are not responsible for damage caused by improper storage or handling after delivery.
• Do not misuse the website, attempt to interfere with its operation, or place fraudulent orders.

13. Intellectual property

The BPC name, logo, and the content of bpcproc.com (text, images, and design) belong to BPC or our licensors. You may not copy, reproduce, or use them for commercial purposes without our written permission. Product names, brands, and logos shown on the site belong to their respective owners.

14. Limitation of liability

To the maximum extent permitted by the laws of Bangladesh:

• We are not liable for indirect or consequential losses, such as construction delays, loss of profit, or losses caused by how materials are used, stored, or installed after delivery.
• Our total liability for any order is limited to the amount you paid for that order.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

15. Events beyond our control

We are not responsible for delays or failure to deliver caused by events beyond our reasonable control — including floods, cyclones or severe weather, strikes or hartals, fuel shortages, road closures, government restrictions, or supply-chain disruptions. If such an event occurs, we will inform you and either reschedule delivery or refund you for undelivered items.

16. Governing law & disputes

These Terms are governed by the laws of the People's Republic of Bangladesh. If a dispute arises, please contact us first — most issues can be resolved quickly and amicably through our support team. If we cannot resolve a dispute together, it will be subject to the jurisdiction of the courts of Dhaka, Bangladesh.

17. Changes to these terms

We may update these Terms from time to time. The version published on this page, with the "Last updated" date above, applies to your use of the website and to orders placed after that date. Continuing to use our services after an update means you accept the revised Terms.
